Regulations of the Online Store for Entrepreneurs

General provisions § 1

  1. These Regulations specify:

a.Rules for registering and using the Store;

b.The conditions for placing orders for Products offered in the Store, delivering the ordered Products to the Store's Customers and paying the Product Prices by the Customers;

c.Rules for submitting and considering complaints.

  1. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended).

Definitions § 2

The terms used in the Regulations have the following meaning

Seller - Le Diplomate Markets Limited Liability Company with its registered office in Warsaw, address: ul. Ateńska 10 lok. U3, 03-978 Warsaw, entered into the register of entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under the KRS number 0000819603, NIP: 9512447890, REGON 368393879, which sells Products for Via the Store.

Store - a website operating at www.lediplomate.pl, owned by the Seller, enabling wholesale of Products via the Internet.

Contractor – a contractor within the meaning of art. 4 of the Contractors' Law Act of March 6, 2018;

Client – a natural person or a legal person or other organizational unit without legal personality, acting by a person authorized, who accepts the Regulations in order to create an Account or conclude a Sale Agreement. If the Customer is a person with limited legal capacity, he / she undertakes to obtain legally effective consent of its statutory representative to make a purchase in the Store and to provide such consent at every request of the Seller;.

Agreement - a Sales contract concluded in the Store on the terms resulting from the Regulations between the Seller and the Customer, the subject of which is the sale of Products to the Customer.

Regulations - this document, constituting an integral part of the Agreement.

Product - goods that the Customer may order through the Store, on the terms set out in the Regulations

  General conditions of using the Store§ 3

1.In order to use the Store and place orders for Products, it is necessary for the Customer to have an active e-mail account (e-mail). The customer obtains on his own access to a computer station or other end device with Internet access and active e-mail.

2.The seller is not responsible for any damage caused by the provision of false, outdated or incomplete data by the customer needed to complete the order and failure to comply with the terms of the Regulations by the Customer.

3.The customer is obliged not to disclose to third parties his login and password used to log in to the Store.

4.As part of using the Store, it is forbidden for customers to provide unlawful content, violating the law or decency. The customer is also obliged to refrain from any activity that could adversely affect the proper functioning of the Store, including in particular any interference with the content of the Store or its technical elements. It is also forbidden to use the Store for purposes contrary to its purpose, including spamming, conducting any commercial, advertising or promotional activities on the Store's website

The Seller provides services by electronic means, in particular:

1.Sale of Products via the website www.lediplomate.pl

2.Newsletter service

 

 Registration in the Store § 5

 

1.The Seller enables the Customers to conclude the Agreement via a previously established Customer account. This service allows customers to use the functionality of the Online Store after logging in.

2.Customer account registration is free and voluntary

3.Registration of the Customer's account takes place after completing the registration form and reading the Regulations and the privacy policy.

4.Upon registration in the Store, a Customer account is created in which information about the Customer and his activities related to the concluded Agreements is collected. Registering a customer account allows you to view the order history and track the status of customer orders

5.After creating the account, the Customer receives a message informing about the creation of the Customer's account to his e-mail address.

6.Registration of the Customer's account is not a condition for concluding the Agreement and viewing the available Products.

7.The customer may consent to receive commercial information electronically by selecting the appropriate option when summing up his order. If such consent is given, the Customer will receive the Store's newsletter (Newsletter) to the e-mail address provided by him.

8.In the event of any change in the Customer's personal data provided during registration, in particular the delivery address, the Customer should update them before concluding the next Agreement, using the appropriate form available in the Store.

9.Each customer who has an account in the store can access the dedicated offer of the store with individually agreed prices and discounts.

10.In order to delete the Customer's account from the Store, an e-mail should be sent to the address kontakt@lediplomate.pl with a request to delete the Customer's account registered in the Store along with all Customer data, including personal data

 

Conclusion of the Agreement § 6

 

1.Before placing an order, the Customer places the selected Product in the Basket that he intends to purchase. The basket is a tool that allows the customer to aggregate selected Products before their purchase, convert the value of the Products collected in the basket and calculate delivery costs.

2.When selecting Products, the Customer may freely manage the content of the Cart by adding more Products to the Cart or removing them from the Cart.

3.After the final selection of Products for purchase, the Customer is directed to the online form used to place orders in the Store. Placing an order takes place after marking the place and method of delivering the Products, the method of payment and completing the order form. The order is confirmed by pressing the 'Place order' button by the Customer.

4.Placing an order constitutes an offer within the meaning of the Civil Code, submitted by the Seller's Customer. After placing the order, the Customer will receive a confirmation of placing the order to the e-mail address provided, which will be equal to the confirmation of the Customer's offer to the Seller.

5.After receiving the order, the Seller verifies that the order has been placed correctly (in accordance with the provisions of the Regulations). If the Seller determines that the order has been placed incorrectly, the Seller will inform the Customer about it.

6.After submitting the correct order, the Seller shall immediately send an e-mail to the Customer about the acceptance of the order (acceptance of the offer) to the e-mail address provided when placing the order or during registration. The contract is concluded when the Seller sends the information about the acceptance of the order to the Customer.

7.If the ordered Product is out of stock or it is not possible to fulfill the Customer's order for other reasons, including if it is not possible to purchase them from the Seller's suppliers within the time provided for the order fulfillment, the Seller will inform the Customer about the situation by sending a message to the address indicated by the Customer. E-mail or provide information by phone to the number provided by the customer.

8.In the event that the implementation of part of the order is not possible, the Seller may propose to the Customer:

a.Cancellation of the entire order (if the Customer selects this option, the Seller will be released from the obligation to complete the order);

b.Cancellation of the order in the part where the implementation is not possible within the prescribed period (if this option is selected by the Customer, the order will be completed in part, and the Seller will be released from the obligation to perform it in the remaining scope);

c.Division of the order and setting a new deadline for this part of the order, the implementation of which is not possible within the originally set deadline (if the Customer chooses this option, sending the Products constituting the order will be made in several separate shipments, and the Customer will not incur additional Costs associated with splitting the order into several shipments).

9.In the event that the Customer does not choose any of the methods of order fulfillment in the situation referred to in paragraph 8 of this paragraph (including in the event that it is not possible to contact the Customer for reasons not attributable to the Seller), the Seller will provide the Customer with Products for which the order can be completed. In the remaining scope, the order will be canceled, about which the Customer will be notified to the e-mail address provided by the Customer in the ordering process.

11.Any ambiguities, problems and inquiries should be reported to the Store staff, which supports the proper operation of the Store's website on an ongoing basis.

12.If the Customer fails to take any decision in the situation referred to in paragraph 8 of this paragraph (including in the event of inability to contact the customer for reasons not attributable to the Seller), the Seller may cancel the order in its entirety.

13.In the case of canceling the order in full in the situation indicated in paragraph 11 of this paragraph, if the payment for the Product has been made in advance, the Seller will refund the amount paid to the Customer (or its part if the order is partially fulfilled).

14.If the Customer provides an incorrect or inaccurate address, the Seller shall not be liable for non-delivery or delay in delivery of the Product

 

Complaints Procedure § 7

 

1.In the event of non-compliance of the delivered Products with the concluded Agreement, the Customer is entitled to a Complaint. The complaint should contain at least:

Name, surname, address, e-mail address of the Client;a

The date of conclusion of the Agreement constituting the basis for the complaint;b

The subject of the complaint, indicating the Customer's request;c

All circumstances justifying the complaint.d

2.The seller considers the complaint within 14 days from the date of its submission. If the complaint cannot be processed within this time, the Seller shall notify the Customer in writing within this period of the reasons for the delay and the expected date of considering the complaint.

3.The Seller shall not be liable for defects in the Products, in particular when the quality of the Products has deteriorated after their delivery to the Customer (Perishable Products, Fresh Products, with short expiry dates, etc.), including if the Customer chooses delivery outside the territory of the Republic of Poland and For reasons attributable to the Customer (e.g. in the event of inadequate storage of the Products))

 Final provisions §  8

1.Placing an order in the manner specified in the Regulations applies only to the purchase of Products whose place of delivery is within the territory of the Republic of Poland. If you want to deliver Products outside the territory of the Republic of Poland, it is necessary to make individual arrangements with the Seller.

2.The administrator of the Customer's personal data is the Seller, ie Le Diplomate Markets Limited Liability Company with its registered office in Warsaw, address: ul. Ateńska 10 lok. U3, 03-978 Warsaw. Detailed provisions regarding the processing of personal data by the Seller can be found in the Privacy Policy www.lediplomate.pl/politykaprywatnosci.

3.The Seller reserves the right to amend or introduce new Regulations. In the event of a change in the Regulations, the new content will be published on the website www.lediplomate.pl/politykaprywatnosci. The Seller shall notify the Customer via e-mail about the change in the provisions of the Regulations or the introduction of new Regulations.

4.The applicable Regulations are available at the Internet address www.lediplomate.pl/regulamin.

5.In all matters not covered by the Regulations, the provisions of generally applicable law, in particular the Civil Code, shall apply.

6.Any disputes between the parties to the Agreement will be settled by the common court competent for the seat of the Seller.)..
